1. Acceptance of Terms

These Terms of Use (“Terms”) are an agreement between you and 91¿ì²¥ (“the College,” “we,” “us,” or “our”) concerning your access to and use of the www.clevelandcc.edu website and all products or services provided on or through it (collectively, the “website”). The materials contained on this website are protected by applicable intellectual property law.

By accessing or using the website, you agree to be bound by these Terms and to comply with all applicable federal, state, and local laws. These Terms apply to all materials, online communications, and other information that is or becomes available on this website. If you do not agree with any of these Terms, do not access or use the website.

1.1 App Store Terms

To use our mobile app, you must have a compatible mobile device. We do not warrant that the app will be compatible with your device. We may issue upgraded versions of the app and automatically update it on your device, but have no obligation to do so. You consent to such automatic upgrading and agree that these Terms apply to all upgrades.

The availability of the app depends on the third party from whom you received the app license, such as the Apple App Store or Google Play (“app store”). You acknowledge that this agreement is between you and 91¿ì²¥, not with Apple, Google, or their app stores. You agree to comply with all applicable third-party terms when using the app. You represent and warrant that you are not located in a country subject to a U.S. government embargo or designated as a “terrorist-supporting” country, and that you are not listed on any U.S. government list of prohibited or restricted parties.  You must be at least 13 years of age to download and use the College’s  mobile application. By using the app, you represent that you meet this age requirement.

1.2 SMS/Text Messaging and Voice Call Services

CCC uses SMS/text messaging and voice call communications to provide information and updates to students, prospective students, employees, and other subscribers. By providing your phone number to the College or opting in through any College channel, you agree to the terms set forth in this section.

SMS/Text Messaging

Program Description. The College may send text messages related to admissions and enrollment, registration and academic updates, student services, financial aid reminders, campus events, important announcements, and promotional messages about College programs and opportunities. Messages may include both informational and promotional content. Message frequency may vary; you may receive multiple messages per week depending on your engagement with the College.

Opt-In. You may opt in to receive SMS messages through any of the following methods: submitting a form on our website and selecting the SMS consent option; completing an application or inquiry and explicitly agreeing to receive text messages; registering for an event and opting into text communications; or communicating with us through other channels and agreeing to receive follow-up messages. Applicants will receive SMS communications only after providing express consent through a form, application, event registration, or other documented opt-in mechanism. By opting in, you provide express consent to receive SMS messages from 91¿ì²¥, including messages sent using automated technology, AI-assisted systems, and/or prerecorded messages, and you confirm that you are the authorized user of the mobile number provided.

Opt-Out. You may opt out of SMS messages at any time by replying STOP to any message. After opting out, you may receive a final confirmation message confirming your unsubscribe request. You may opt back in at any time through any available opt-in channel. 

Help. For assistance with SMS communications, reply HELP to any message or contact 91¿ì²¥ at the information listed in Section 22 of these Terms.

Message and Data Rates. Message and data rates may apply based on your wireless carrier plan. 91¿ì²¥ is not responsible for any charges from your wireless provider. Mobile carriers are not liable for delayed or undelivered messages. Message delivery may be affected by carrier network conditions.

Privacy. Information collected in connection with SMS communications is subject to the 91¿ì²¥ Privacy Statement available on our official website.

Service Availability. SMS message delivery is subject to effective transmission by your mobile carrier and may be limited by carrier coverage, network availability, or other factors outside the College’s control. Supported carriers, message types, and compatible devices may vary.

SMS Data Retention. SMS-related information, including your mobile number and consent status, is retained only for as long as necessary to fulfill the purposes described in this section or as required by applicable law. When no longer needed, such information is securely deleted or anonymized.

No Condition of Enrollment. Consent to receive text messages is not a condition of admission, enrollment, employment, or receipt of services from 91¿ì²¥.

Voice Call Communications

Consent to Receive Calls. By providing your phone number to 91¿ì²¥, you consent to receive phone calls from the College, which may include calls made using automated technology, AI-assisted systems, and/or prerecorded or artificial voice messages. These calls may be made for both informational and promotional purposes, including admissions and enrollment communications, application status and follow-ups, event reminders, student engagement and support, and promotional information about College programs and opportunities.

AI-Assisted and Automated Calling. Some calls may be conducted or supported by automated systems or AI-assisted technology. These technologies may be used to deliver prerecorded or partially automated messages, assist representatives during live calls, or route and respond to inquiries. You may request to speak with a live representative during a call, where applicable.

Call Recording and Monitoring. Phone calls with 91¿ì²¥ may be recorded and/or monitored for quality assurance, training and evaluation, record-keeping, and compliance purposes. By engaging in a call with the College, you acknowledge and agree that the call may be recorded where permitted by applicable law.

Call Frequency. The frequency of calls may vary based on your interaction with the College, including your inquiry status, application activity, event participation, or engagement with College programs.

Opt-Out of Phone Calls. You may opt out of receiving phone calls at any time by informing the caller during any call, contacting the College using the information provided in Section 22, or following any opt-out instructions provided during the call. 91¿ì²¥ maintains an internal Do-Not-Call list and honors requests to be placed on that list within the timeframes required by federal law.

TCPA Compliance. 91¿ì²¥ strives to comply with all applicable laws and regulations related to phone communications, including the Telephone Consumer Protection Act (TCPA) and other relevant regulations governing automated calls, prerecorded messages, and call recording.

No Condition of Enrollment. Consent to receive phone calls is not a condition of admission, enrollment, employment, or receipt of services from 91¿ì²¥.

2. Changes to These Terms

CCC reserves the right to revise these Terms at any time for any reason, with or without notice, by posting the revised version on our website. You can determine when we last updated these Terms by referring to the “Last Updated” date above. Your continued use of the website following any posted changes constitutes your acceptance of those changes. We recommend reviewing this page periodically.

3. Accounts and Registration

To use certain features of the website, you must register for an account and provide accurate information. Each registration is for a single user only. By creating an account, you agree to:

  • Provide accurate, current, and complete account information and keep it updated.
  • Maintain the security of your account credentials.
  • Be responsible for any activity that occurs through your account.
  • Immediately notify us if you discover or suspect any security breach related to your account.

You may update your account information at any time by following the instructions on the website. 91¿ì²¥ may suspend or terminate your account in accordance with Section 12 below.

The website and its entire contents, including all web pages, graphics, photographs, downloadable materials, software, text, displays, images, video, and audio, are the property of 91¿ì²¥, its licensors, or other providers and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws. 91¿ì²¥ retains copyright to all web pages and content under the clevelandcc.edu domain. Contributing writers, photographers, and artists retain ownership of their individual works and are credited as such where applicable. These Terms do not transfer any intellectual property rights to you, except for the limited license set forth in Section 4. All rights not expressly granted are reserved.

6. Communication Services

The website may contain bulletin boards, chat areas, forums, communities, calendars, and other message or communication facilities (collectively, “Communication Services”) designed to enable communication among users. You agree to use Communication Services only to post, send, and receive messages and material that are appropriate and related to the particular Communication Service.

When using any Communication Service, you agree not to:

  • Defame, abuse, harass, stalk, threaten, or otherwise violate the legal rights of others.
  • Publish, post, or distribute any inappropriate, profane, defamatory, infringing, obscene, or unlawful content.

Managers and hosts of Communication Services are not authorized College spokespersons, and their views do not necessarily reflect those of 91¿ì²¥. Always use caution when sharing personally identifying information within any Communication Service.

7. Privacy and Information Collection

Your privacy is important to us. 91¿ì²¥ collects certain non-personally identifying information from visitors to the website, such as browser type, screen resolution, pages visited, and other aggregate usage data. This information is used solely to improve the website experience. Personally identifying information such as your name or address is not collected through general website browsing. This information is not sold or used in any way harmful to visitors.

Password-protected areas such as student portals and learning management systems are governed by separate privacy practices and are not included in general website data collection.

Personal information may be protected by the Family Educational Rights and Privacy Act (FERPA). 8. User Content

12. Term and Termination

These Terms remain in effect while you use the website. 91¿ì²¥ may suspend or terminate your access at any time, for any reason, at its sole discretion, including for any violation of these Terms. Upon termination, your right to access and use the website ends immediately, and any downloaded materials in your possession, whether in electronic or printed format, should be destroyed. Provisions of these Terms that by their nature should survive termination, including ownership, warranty disclaimers, and limitations of liability, shall continue to apply. 91¿ì²¥ will not be liable to you for any termination of your access or deletion of your account or content.  Third-party websites and services linked from or embedded within the 91¿ì²¥ website are not under the College’s control, and the College cannot guarantee their accessibility. ANY CAUSE OF ACTION OR CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE WEBSITE MUST BE COMMENCED WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES. OTHERWISE, SUCH CAUSE OF ACTION OR CLAIM IS PERMANENTLY BARRED.
